However, when the union has knowledge of a proposed change and a reasonable opportunity to negotiate over the subject, but nevertheless fails to request to bargain over such a proposed change, it has waived the bargaining obligation. See Town of Watertown, 32 MLC 54, 56 (2005) and cases cited therein.
Also in this case, because DeBow-Huang offered to meet with Trahon, the Unions situation is similar to that of the union in Suffolk County Sheriff's Department, 29 MLC 21, MUP-01-2911 (July 18, 2002). In Suffolk County Sheriffs Department, the employer converted to a new software program in November of 1999 that did not include differentials in the overtime calculation. The Union discovered the problem in December of 1999 or January of 2000.
