I have directed a member of my staff, August Bottorf, to review this matter. Upon completion of the review, I will advise you in writing of the disposition of this case. If in the interim you receive a satisfactory response to your request, please notify this office immediately.
Hertz: I am Town Counsel for the Town of Acton. I am writing to attempt to resolve the outstanding issues with your Public Records request. I understand that you are upset by the lack of timeliness in the Towns response. The Town was, however, taking the time needed to prepare appropriate logs for you, at your request, to determine the veracity of the Towns exemption and privilege claims. That process took longer than anticipated.
I am not sure why attorney-client privilege would come into play since I am not requesting documents of legal advice or review between attorney and client (the Town of Acton). For these items, as well as exception items we continue to debate, there is a provision for allowing a member of the Commonwealth Supervisor of Records to make an in-camera determination as to whether an exception or privilege should apply.
