It is undisputed that the City of Boston created the Assistant Hospital Director title prior to 1996 in its Department of Health and Hospitals (DHH) when DHH operated City Hospital. Mr. Killarney was an Assistant Hospital Director at DHH when the BPHC was created in 1996, and he did not work in the field of property management as his DHH job description confirms. (See Ex. 8).

The Labor Relations Commission (LRC) certified the SENA unit at the City of Boston in 1986 - ten (10) years before the BPHC came into existence. The BPHC was created by statute in 1996 and became the public employer of a large group of employees of the Trustees of Health and Hospital (Trustees) and a very small group of SENA members formerly employed by the City of Boston (DHH).
See City of Boston, 35 MLC 137, 140 (2008) (setting forth the accretion standards). CONCLUSION For the reasons asserted herein and in the Unions original position statement and further position statement, the Union respectfully requests that the Department engage in further factfinding as necessary and ultimately order the accretion of the above-referenced positions into its existing bargaining unit.
SENA claims these formerly part of its City of Boston bargaining unit before the BPHC separate employing entity in 1996 and should be restored titles were became a to its unit. SENA further claims that these titles share a community of interest with its existing unit.
