The APPA cites first City of Boston, 41 MLC 119 (2014) [APPA Brief at 4]. As the APPA concedes in a footnote and as the Town pointed out in its initial Memorandum, the CERB actually ruled on the case by dismissing the charges because the three police unions had failed to establish a past practice regarding non-use of assessment centers [APPA Brief at 4 n.3]. See City of Boston, | id. at 126.
In City of Boston, 41 MLC 119 (2014), the Commission ruled on charges brought by three of the citys police unions, including that which represents officers holding the rank of patrolman and another which represents officers holding the ranks of sergeant and above.
ARGUMENT The Town first argues that the 1977 Boston School Committee case, the 2010 Worcester Sheriffs case (H.O.), and the 2014 City of Boston cases are all either cursory or dicta-based or unfounded in their statements or direction that promotional criteria/processes for positions outside the bargaining unit are indeed a mandatory subject.
