City of New Bedford, 15 MLC 1732, 1737, MUP-6488 (May 31, 1989). Here, the evidence shows DPH has used agency staff to meet its pandemic cleaning needs at Shattuck since 2020. Although this charge arose out of the Unions concerns over the Employers continued use of such staff after June 2021, the Union provided no evidence that this resulted in a calculated displacement of bargaining unit work, as defined in the preceding paragraph.
See City of New Bedford, 15 MLC 1732, 1737 (1989). This is neither a case of replacing unit employees with outside contractors, nor for the reason of saving costs. Compare, Commonwealth of Massachusetts and AFSCME, Council 93, SUP-3835 (March 13, 2000). In this case, it has not been alleged that bargaining unit members are being laid off or replaced by contractors. See Article 15.
