The assistant city solicitor at the time sought guidance from the Public Employee Retirement Administration Commission (PERAC). Id. PERAC opined that the member would not be entitled to accidental disability retirement because he was not on duty, and acting outside his job description. Id. The Newton Retirement Board opined similarly.
The City indicated that it would contact the Public Employee Retirement Administration Commission (PERAC) regarding the accidental disability issue.
