The appeal was dismissed on July 11, 2014 after the parties represented that they had reached a settlement agreement. Shortly thereafter, the plaintiff, pro se, filed a motion to reopen the appeal that was allowed in September 2014. After some preliminary motions, a hearing was held on November 12-14, 2014, in North Adams.
