Stein DECISION The Appellant, David OBrien, appealed to the Civil Service Commission (Commission) pursuant to G.L.c.31, 2(b), claiming that he was denied appointment as a Firefighter with the City of Fall River Fire Department (FRFD) because the Massachusetts Human ResourcesDivision (HRD) wrongfully reported to the FRFD that he had failed the Physical Abilities Test (PAT) administered by HRD.
In regard to BYPASS 1, the Boston Police Department notified the states Human ResourcesDivision (HRD) that it was bypassing the Appellant for appointment for the following two (2) reasons: a) being rejected for employment by the Winthrop Police Department for fail[ing] to provide truthful responses in his application related to his place of residence; and b) failing to acknowledge that his drivers license had once been suspended.
