The Town and the Union agree to use every reasonable effort to prevent grievances from arising and to accomplish just and reasonable settlements. Section 2.
ARTICLE 12 GRIEVANCE and ARBITRATION 12.1 The purpose of this Article is to establish a procedure for the settlement of grievances, which involve the interpretation, and application of a specific provision of this Agreement. A grievance shall mean a complaint by an employee that as to her/him the School Administration has interpreted and applied this Agreement in violation of a specific provision hereof.

This hearing officer tried to mediate a settlement at the conclusion of the hearing; yet was unsuccessful. substantially identical claims addressed in the Clarkson Award which is not repugnant to the purposes of the Law; (2) the Complaint raises issues of contract interpretation which are proper for arbitration; (3) the statutory issues raised by the Complaint are well-settled; (4) deferral would conserve the resources of both the DLR and the parties; (5) deferral would discourage inconsistent awards; and (6) deferral would promote the prompt and effective settlement
(see Exhibit 1, page 2), the Union has made no reasonable attempt to pursue settlement or any resolution of this matter with the District prior to or since filing this Charge. This Charge is a frivolous, premature exercise undertaken by the Union. The parties time and resources would have been far better spent if the Union had consulted with the District regarding potential resolution prior to filing this Charge.
