Ironically, both City of Boston, supra, 41 MLC at 126, and Wilbraham, supra, 1777, also cited Town ofDanvers, 3 MLC 3 MLC at 5 MLC at 1559 (1977), but failed to note that the Danvers case made statements which distinguished criteria for intra-unit promotions from criteria for promotions outside the unit. | The APPA does also rely on the statements made in Boston Sch.
The hearing officer dismissed the charge, however, by finding that the union had waived any bargaining obligation. ' As discussed later in this memorandum, however, Town ofDanvers actually contains statements and analysis which support the Towns argument here. 5 Id. at 148.
