It is our understanding that an Open Meeting Law complaint based on the same facts was investigated and closed by the Cape andIslandsDistrictAttorney in June 2010. During that investigation, it was determined that the Board failed to maintain records of executive sessions. To resolve the matter, the Board was reminded of its obligation to maintain records of executive sessions under the law.

The BPD Police Chief reported the Appellant to the Cape andIslandsDistrictAttorneys Office to determine whether the Appellant should be added to the Brady List in that office. According to the Chief, the District Attorneys Office subsequently determined that the Appellant should be added to that offices Brady List, a development the Appellant stated that he was unaware of at the time of the pre-hearing conference.
