The BERS referenced in paragraph 3 had been previously employed by the Department of Public Health in the Medical Marijuana Program. Chapter 55 of the Acts of 2017 amended General Laws, Chapter 10, Section 76 to establish the Cannabis Control Commission (Commission), and the BERS transferred to the Commission on or about December 27, 2018. At all relevant times, the BERS were unit 8 employees represented by the Union.
Previously, these particular jobs were in the Department of Public Health (DPH). After the creation of the Commission, these positions were transferred to the Commission. The transfer from DPH to the Commission occurred on or about December 27, 2018. However, at all points relevant to this charge, they have been, and continue to be, covered by Local 509s collective bargaining agreement with the Commonwealth.
