The DA's office provided the contract in redacted form, stating 'certain redactions were made pursuant to' exemption c and a specific statute. The response does not specify the nature of the redacted material or provide any specific reasons for redacting the information.
In consultation with the Norfolk DistrictAttorneys Office, although there may be some post-conviction appeals ongoing with their office, they were not opposed to releasing some documents upon the filing of a public records request. A review of the case file that is in the possession of the Police Department revealed that there [are] a number of documents in existence that are covered under this request.
The complaint was originally filed on June 26, 2010 with the Norfolk DistrictAttorney. The Attorney General assumed responsibility for enforcement of the Open Meeting Law as it applies to local public bodies, such as the Board, on July 1, 2010. As you are aware, prior to that date enforcement authority for the Open Meeting Law as it pertained to local public bodies was vested in the District Attorney.
Specifically, in light of statements from the Norfolk DistrictAttorney's Office indicating that it is not taking further action against any of the officers, I find the Department must clarify whether its investigation remains ongoing.
