The many problems with this document are these: The Malden Fire Department did not inform the Civil ServiceCommission or the Division of Administrative Law Appeals that it could not comply with the discovery order ~ and that if it could comply, it would not comply with what it calls the second request. The Malden Fire Department made an objection about privilege but not to the Civil Service Commission, which could actually have ruled on it.
Since the Appellant has also filed a discrimination complaint with the Massachusetts Commission Against Discrimination regarding the same issue, the Civil Service Commission is dismissing this appeal until the MCAD has issued a final decision on the Appellants complaint.
The Appellant filed a timely appeal with the Civil Service Commission. A pre-hearing conference was conducted at the offices of the Civil ServiceCommission on April 24, 2006 before Commissioner Marquis. On October 11, 2005, the Town sought approval from the Personnel Administrator (HRD) to bypass the Appellant for original appointment as police officer. Their justification was three-fold.
