OF MASSACHUSETTS, DEPARTMENT OF PUBLIC HEALTH, Respondent, ) ) ) ) ) ) ) ) ) SUP-22-9097 CHARGING PARTY'S REQUEST FOR REVIEW NOW COMES the Charging Party, AFSCME Council 93 (hereinafter "Charging Party" or "Union") and pursuant to 456 CMR 15.05(9), respectfully requests that the Commonwealth Employment Relations Board (hereinafter "CERB") review the Dismissal of the Charge set forth in SUP-22-9097.
Additionally, the Charge must be dismissed because additional contractors were utilized to fill on-going staff-shortages during the ongoing public health emergency, and such use of contractors in addition to bargaining unit members does not transfer bargaining unit work at all, let alone to the detriment of the bargaining members, where the Union Facility Service Workers at the Shattuck Hospital are a group of employees employed under the purview of the Department
It alleged that the Commonwealth of Massachusetts, acting through the Department of Public Health (Employer or DPH), violated Section 10(a)(5) and, derivatively, Section 10(a)(1) of M.G. L. c. 150E (the Law) when, after the Governor of Massachusetts lifted the COVID-19 state of emergency, it continued to use outside contractors to perform janitorial bargaining unit work at Lemuel Shattuck Hospital (Shattuck).
Kelly: On February 1, 2022, AFSCME, Council 93, Local 1114 (Union) filed a charge of prohibited practice with the Department of Labor Relations (DLR) alleging that the Commonwealth of Massachusetts, Secretary of Administration and Finance, Department of Public Health (Employer) had engaged in prohibited practices within the meaning of Section 10(a)(5) and derivatively 10(a)(1) of Massachusetts General Laws, Chapter 150E (the Law).
