On March 13, 2017, I held a pre-hearing conference at the Armand Mercier Community Center in Lowell, MA, which was attended by Mr. Martin, his counsel and counsel for the Housing Authority. Prior to the pre-hearing, the Housing Authority 1 submitted a Motion to Dismiss the Appellants appeal, arguing that the Commission does not have jurisdiction to hear an appeal from a Housing Authority employee who has been demoted.
