Massachusetts Parole Board, 18 MCSR 216 (2005) Applicable Civil Service Law Under G.L.c.31,43, a tenured civil service employee aggrieved by a disciplinary decision of an appointing authority made pursuant to G.L.c.31,41, may appeal to the Commission. The Commission has the duty to determine, under a preponderance of the evidence test, whether the appointing authority met its burden of proof that there was just cause for the action taken.
