The Union is merely trying to use this modification to job duties to obtain that which it could not obtain through bargaining. The DLR is reticent to allow modifications and should not do so in this instance.

City of Boston, 6 MLC 1117, 1126, MUP-2863 (June 4, 1979). In such circumstances, a union must prove that an identifiable pattern existed regarding the assignment of the work and that the employer has altered that pattern without first bargaining with the union. Id. at 1126.

The existence of strong ties to a community and/or the intention to move there are not necessarily sufficient to establish a person to have resided in a community in which they do not then actively live full-time. To be eligible for this benefit, the employee must demonstrate on the appropriate documents that he or she is covered by a group or non-group health insurance plan financed without any participation by the Lawrence School Committee or the City ofLawrence.
