In this case, the Union was on notice of the alleged violation as of October 3, 2018 at the latest, yet the Charge was not filed within six months of that date, the date when the STA indisputably became aware of the Confidentiality Agreement requirement. The Union failed to file its Charge within six months of that date.
City ofBoston, MUP-3171 (July 1, 1971)(Unfair labor practices cannot be found if the only evidence that establishes illegality is drawn from before the statutory period). Thus, to avoid dismissal on timeliness grounds, the Union needed to present evidence that, within the six months preceding the charge, the School Committee had actually required an STA member to sign the Agreement as a condition of participating on a hiring committee.
