Sometime in the spring of 2017, the Union learned that the Commonwealth of Massachusetts, through the Executive Office of Health and Human Services (Employer), planned to enter into a contract with New England Geriatrics (NEG), and that NEG employees might potentially perform Social Worker duties. Around August 2017, the Union and the Employer collaborated on a Behavioral Management Policy (Policy). The Policy was finalized in September 2017.

The Department of Developmental Services (DDS) is a division of the Commonwealths Executive Office of Health and Human Services. DDS provides residential, vocational, medical and rehabilitative services to residents of the Commonwealth with intellectual disabilities. At the time the complaint was filed, DDS provided services at the Fernald Developmental Center, (Fernald), where a number of DSWs were employed.

Since May 8, 2000 I have been employed by the Commonwealth of Massachusetts Executive Office of Health and Human Services as a Director of Metro Residential Services, Program manager VIII for the Metro Region of the Department of Developmental Services. My duties include, but are not limited to, oversight of thirty licensed group homes and three hundred and eighty-five staff for the Department of Deyelopmental Services in the Metro Region.
