Turco appealed SRBs decision to the Division of Administrative Law Appeals (DALA). 14. On December 23, 2016, DALA affirmed SRBs decision. 15. On December 28, 2016, Ms. Turco forwarded an email to DOC stating: Kelley, this e-mail, per our conversation today, is a request to be re-hired. I did retire from Lemuel Shattuck Hospital December 19, 2015.

The appeal was heard by a magistrate at the Division of Administrative Law Appeals (DALA). Finding 2 of that decision states that the Appellant received a permanent appointment to position of laborer / motor equipment operator [labor service titles] on August 31, 2001. Apparently, the broader issue, now before the Commission, of whether any labor service employee hired after 1998 can be considered permanent, was not addressed.

On June 1, 2012, Officer Lynch's appeal from promotional bypass was heard by a Division of Administrative Law Appeals magistrate. Department Chief Christopher Delmonte testified and was aggressively cross-examined by counsel for Officer Lynch. On June 4, 2012, the Department initiated a disciplinary investigation against Officer Lynch.

On April 12, 2013, Division of Administrative Law Appeals (DALA) Administrative Magistrate Maria Imparato (Imparato) held a hearing concerning Aimes appeal and on July 1, 2013, DALA recommended that the Civil Service Commission affirm the decision to suspend Aime.

The Division of Administrative Law Appeals (DALA), by decision dated January 13, 2023, upheld the QRBs decision. The Appellants further appeal of the denial of his disability retirement application to the Contributory Retirement Appeals Board (CRAB) is pending.
