On June 1, 2012, Officer Lynch's appeal from promotional bypass was heard by a Division ofAdministrativeLawAppeals magistrate. Department Chief Christopher Delmonte testified and was aggressively cross-examined by counsel for Officer Lynch. On June 4, 2012, the Department initiated a disciplinary investigation against Officer Lynch.

On April 12, 2013, Division ofAdministrativeLaw Appeals (DALA) Administrative Magistrate Maria Imparato (Imparato) held a hearing concerning Aimes appeal and on July 1, 2013, DALA recommended that the Civil Service Commission affirm the decision to suspend Aime.
