In a May 1J1h email to a member of the Public Records Division staff, you confirmed that "there is no death certificate with the Registry or with the City ofLynn." Under the Public Records Law, the Registry is not required to create a record in response to a public records request. In addition, a public employee is not required to answer questions, or do research, or create documents in response to questions. See G. L. c. 66, 6A(d); 32 Op.
On October 1, 2009, HRD delegated the civil service promotion approval process to all cities and towns, including the City ofLynn. HRD provides Lynn with an eligible list when it is established.
Next, the City relies on G.L., c. 31 (Chapter 31 or Civil Service), Section 7(d) of G.L. c. 150E and City ofLynn v. Labor Relations Commission, 43 Mass. App. Ct. 172 (1997), to argue that its decision to assign Lieutenant Gamby as commander of Investigations was based on core managerial policies that exempted it from bargaining with the Union.
