City of Boston, 32 MLC 1, 2 (2005). Here, the Employer contends that it had legitimate and substantial concerns about disclosing an employees personnel file that stemmed from its employees statutory privacy rights. The Employer asserts that because Lopes is the only one who could waive the privacy rights he had in his personnel file, the Employer did not violate any law by requiring Lopes to authorize the release of his file to the Union.

In those cases, employers must make City of Boston, 31 MLC 25, 33 (2004). Here, the loss of Webbers and Woods overtime was an inevitable consequence of the Towns managerial decision to hire Santos and to order Webber and Wood perform scrap metal duties on a straight-time basis. to Impact bargaining could therefore only have ameliorated and not changed the effect of the Towns decision.

Town of The CERB has continued the distinction between unscheduled and scheduled overtime, holding in City of Boston, 32 MLC 4, 13 (2005) that the city did not need to bargain over the unscheduled overtime lost by virtue of the citys decision to transfer riot control work to non-unit detectives.
Over a year earlier, the City of Bostons police department, informed the employee that its off-duty employment policy was under review and that it would take no action on his application pending review.
