.: D1-12-222 DEPARTMENT OF CORRECTION, Respondent DECISION Pursuant to G.L. c. 31, 2(b) and/or G.L. c. 7, 4H, a Magistrate from the Division ofAdministrativeLawAppeals (DALA), was assigned to conduct a full evidentiary hearing regarding this matter on behalf of the Civil Service Commission (Commission). Pursuant to 801 CMR 1.01 (11) (c), the Magistrate issued the attached Tentative Decision to the Commission.
The matter was heard by the Division ofAdministrative LawAppeals, which issued a Recommended Decision recommending that the Commission affirm the action of the Appointing Authority.
After a hearing before a magistrate of the Division ofAdministrativeLawAppeals, the parties agreed in writing that this discipline would be reduced to a written reprimand and (even though the precise contents of that reprimand remained in dispute) an earlier Chapter 31 appeal brought by the Appellant resolved on that basis some four years ago. See Commission and DALA decisions published on January 17, 2019 in Savage v.
The appeal was heard by a magistrate at the Division ofAdministrativeLawAppeals (DALA). Finding 2 of that decision states that the Appellant received a permanent appointment to position of laborer / motor equipment operator [labor service titles] on August 31, 2001. Further answering, the Commonwealth states that on August 16, 2012 - after the August 13 in-person investigation conducted in this case - the Commonwealth received the Recommended Decision of the Division ofAdministrativeLawAppeals (DALA) in CSC Docket No. D-11-35.

A full hearing was scheduled for March 28, 2006 before an administrative magistrate from the Division ofAdministrativeLawAppeals (DALA) designated to serve as hearing officer by the Chairman of the Civil Service Commission. Rather than go forward with a full hearing, the parties agreed to settle the matter.
