Town of Burlington v. McCarthy, 60 Mass.App.Ct. 914, 915 (2004). The essential issue being evaluated in a bypass appeal to the Commission remains whether or not the appointing authority has reasonable justification, under basic merit principles, to select a candidate whose performance on the civil service qualifying examination placed him 9 lower than the bypassed candidate, thus skipping over a higher ranked candidate for a valid reason.
