In that case, the Town takes the position, first, that the matter does not impact a term and condition of employment, but, second, that the recent legislation and subsequent regulations of the State 911Department, requiring dispatchers to have enhanced certification (see 560 CMR 5.00, et seq.), created an exigency that required the Town to act.
On or about October 19, 2020 the Union became aware that the Commonwealth intended to reputiate paragraph #3 of a Memorandum of Agreement entered into between the parties, Paragraph #3 reads; "Dispatchers currently under the employ of the Commonwealth's State Police and State 911Departments shall be placed at the step within their newely classified grade as determined by the promotional factor in Article 12, Section 5 of the Unit 2 Collective Bargaining
The Commonwealth of Massachusetts State 911Department issued the Appellant a certification. During her stage-four evaluation, the Appellant received all 6s and 7s, which equate to all As and Bs. (Testimony of Appellant Resp. Ex. 8) 3. The BFD has a Fire Alarm Operations Division (Operations) and a Fire Suppression Division. (Stipulated Facts) 4. Members with degrees from schools of higher education will receive the following stipends in regular bi-weekly paychecks: Associates Degree Bachelors Degree $700.00 ($26.92 per pay period) $950.00 ($36.54 per pay period) ARTICLE 20 TRAINING REQUIREMENTS All PSTs shall meet and maintain certification in accord with the State 911Department regulations (560 CMR).
