Effective July 1, 2024 - 1.5% Town proposal regarding withdrawal from Civil Service - The Town wishes to make it clear that the Town is not asking a JLMC interest arbitration panel to award withdrawal from the jurisdiction of the the Civil Service Commission. The Town is requesting that the JUMC interest arbitration panel determine that the Town has met all bargaining requirements under General Laws, c. 150E with respect to said withdrawal.

As acondition precedent to submitting a grievance alleging a violation Section 1 of this Article, the Union and the employee involved shall sign and give to the Authority, on a form prepared by the Authority, a waiver of any and all rights to appeal the disciplinary action to any other forum including the Civil Service Commission. The waiver shall include a declaration that no other disciplinary review has been commenced. Section 5.

Candidates will remain responsible for all Massachusetts Civil Service Commission and the testing fees as well as any additional private tutoring on training. The Chief shall assign a high-ranking officer represented by the Association who is not a candidate for promotion to serve as a liaison to handle logistical issues related to the exam. There shall be no observers at the assessment center who are employed by the Medford Police Department.

It is clearly understood that the Arbitrator may not contradict or modify the terms of this Agreement or render a decision which is in conflict with the express provisions of this Agreement or any ordinance or law, rules or regulations of the Civil Service Commission or of any Retirement Board established by law, that are in effect at this time of ratification or any subsequent continuation, ratification or extension of this Agreement.

The parties Agreement provides that, The Town and/or the Appointing Authority shall make appropriate advance arrangements with the Civil Service Commission to hold competitive examinations for the positions of Lieutenant, Captain and Deputy Chief at two year intervals. 42.In July 2013, Chief Stark requested that the Union agree to offer the Lieutena nts exam one year early to fill a vacant Lieutenant position.
In addition to that Grievance, Captain Murphy also filed an Appeal with the Civil Service Commission. Both the Grievance and the Civil Service Appeal protesting the Chiefs promotion to Deputy Chief have been contentious and extremely visible issues in the Fire Department ever since they arose in the beginning of the month of March, 2014. 3. The Union submitted Captain Murphys Grievance to Arbitration on June 9, 2014.
