Relying on City of Boston, 35 MLC at 291 (citing MacCormack v. Boston Edison Co., 423 Mass. 652, 662 (1996)) and LaRou v. Ridlon, 98 F.3d 659, 663 (1st Cir. 1996), the Committee next argues that removing Ms. Pierces name from the faculty list and deleting her e-mail account were not adverse actions because she was not materially disadvantaged by those actions.
It is also without question; Superintendent of Somerset Public Schools, Richard Medeiros (Hereinafter Superintendent), along with me and amongst others, was present for the above state arbitration hearing which took place at the Department of Labor Relations in Boston MA. Pierce Testimony; Medeiros Testimony. On or about July 2, 2013 Mr. Raymond Nekrasz (Hereinafter Mr.
Boston failed to demonstrate adverse action that City of Boston, 35 MLC Edison Co., 423 Mass. 652, 662 (1996) (plaintiff action element of a prima facie case of unlawful retaliation where there was no evidence that he had been disadvantaged with respect to salary, grade or other objective terms and conditions of employment); accord City of Holyoke, 35 MLC 153, 156, MUP-05-4503 (January 9, 2009).
Sec 15 City of Boston, 35 MLC 289, 291 (2009)(citing MacCormack v. Boston Edison Co., 423 Mass. 652, 662 (1996)(failure to prove adverse element of prima facie case where there was no evidence that he had been disadvantaged in respect to salary, grade, or other objective terms and conditions of employment). In order for an employer to take adverse action, the individual in question must be an "employee" of the employer.
