In sum, the decision of the Hearings Officer ignores that the settlement challenged by Mr. McLean and entered into between MOSES and the Commonwealth violated public policy. As such it should be set aside and the Hearing Officers decision dismissing Mr. McLeans charge should be overturned. RELEVANT BACKGROUND! Mr.
After agreeing in principal to a full resolution of the matter, MOSES and the Employer jointly requested that the DLR dismiss CAS-14-3455 with prejudice, pending a settlement agreement. The DLR closed CAS-14-3455 on May 21, 2014. MOSES and the Employer concluded negotiations for a collective bargaining agreement (CBA) effective July 1, 2014 through June 30, 2017. That CBA was ratified by the bargaining unit membership in June 2014.
The parties subsequently engaged in further settlement negotiations. On May 21, 2014, the parties filed a Joint Request for Dismissal Without Prejudice of CAS-14-3455 on the basis that they agreed in principal to a full resolution of the matter pending a settlement agreement and subsequent negotiation.
