The Department's December 13'/z response In its December 13, 2018 response, the Department indicates "[f]or years 2016, 2017, and 2018, records relating to the named employee's work schedule are maintained by the Office of Human Resources within the Executive Office ofHealthandHumanServices (EOHHS).

Upon a careful review of this matter, it is my finding that the Governor's Office may permissibly withhold this set of records pursuant to the attorney-client privilege.
In two separate letters, both dated January 24, 2012, the Charging Party provided written notice to John Auerbach, Commissioner of the Department of Public Health, and James Montgomery-Hyde, Director of Human Resources of the Executive OfficeofHealth andHumanServices, of his desire to withdraw authorization for agency service fee payroll deductions. See Exhibits C and E of the Charge.
