In November 2018, MassDOT filed a Motion to Dismiss the Classification Appeal on grounds that Fitzgerald had since been promoted and thus, his current grade and title were different from when he first filed the Classification Appeal. The Commission held a pre-hearing conference on the Motion to Dismiss.
SUPL-21-8765 Civil Service Appeal On or about September 7, 2013, Fitzgerald filed a classification appeal with the Civil ServiceCommission (Commission) under Massachusetts General Laws, Chapter 30, Section 49. In the appeal, Fitzgerald sought reclassification as a Civil Engineer III (CE III).
