Officer Gutwill appealed his 5-day unpaid suspension for untruthfulness to the Massachusetts Civil ServiceCommission. See Charge Attachment A, p. 1 ~J 6. 12. Shortly before the Civil Service Commission hearing was to take place, Gutwill voluntarily withdrew his appeal. See Exhibit D, Withdrawal of Appeal dated January 17, 2018. 13.
On September 18, 2017, Gutwill appealed the five (5) day unpaid suspension to the Civil ServiceCommission. See Gutwill v. Framingham Police Department, Civil Service Commission Docket No.: D-17-182. Stipulations, 24. The parties collective bargaining agreement (CBA) mandates that officers file appeals of disciplinary suspensions to the Civil ServiceCommission. Stipulations, 26.
Gutwill also filed a Civil ServiceCommission appeal (which was subsequently dismissed) regarding a 5-day suspension related to the allegations discussed in J 5. he In addition, on or about October 28, 2016, Gutwill filed a federal lawsuit against the City and its police chief for, among other things, civil rights violations, retaliation, and violating the state's whistleblower statute related to the above mentioned criminal malfeasance he had exposed
He appealed the suspension to the Civil ServiceCommission but he ultimately withdrew his appeal. See Joint Exhibit 1. 5. Upon returning from his suspension, Gutwill was assigned to the Patrol Division due to the untruthfulness finding. Stipulations 27.
