Officer Gutwill appealed his 5-day unpaid suspension for untruthfulness to the Massachusetts Civil Service Commission. See Charge Attachment A, p. 1 ~J 6. 12. Shortly before the Civil Service Commission hearing was to take place, Gutwill voluntarily withdrew his appeal. See Exhibit D, Withdrawal of Appeal dated January 17, 2018. 13.
On September 18, 2017, Gutwill appealed the five (5) day unpaid suspension to the Civil Service Commission. See Gutwill v. Framingham Police Department, Civil Service Commission Docket No.: D-17-182. Stipulations, 24. The parties collective bargaining agreement (CBA) mandates that officers file appeals of disciplinary suspensions to the Civil Service Commission. Stipulations, 26.
Gutwill also filed a Civil Service Commission appeal (which was subsequently dismissed) regarding a 5-day suspension related to the allegations discussed in J 5. he In addition, on or about October 28, 2016, Gutwill filed a federal lawsuit against the City and its police chief for, among other things, civil rights violations, retaliation, and violating the state's whistleblower statute related to the above mentioned criminal malfeasance he had exposed
He appealed the suspension to the Civil Service Commission but he ultimately withdrew his appeal. See Joint Exhibit 1. 5. Upon returning from his suspension, Gutwill was assigned to the Patrol Division due to the untruthfulness finding. Stipulations 27.
On September 18, 2017, Gutwill appealed the five (5) day unpaid suspension to the Civil Service Commission. See Gutwill v. Framingham Police Department, Docket No.: D-17-182. 25. On January 17, 2018, Gutwill voluntarily withdrew his Civil Service Disciplinary Appeal and the Civil Service Commission dismissed the case.
