In City of Quincy, 6 MLC 2144 (1980), the city specifically reserved the right during bargaining to withdraw a proposal in the event that the Legislature passed a tax cap. The Legislature did pass the cap and the city withdrew the proposal. The Board found that the City had not engaged in bad faith /d. at 2145-2146. bargaining by withdrawing its wage offer as the city withdrew a conditional offer which the union had already rejected.
