(Exhibit 2) (3) Three days earlier on August 10, 2012, | was at a Civil Service Commission hearing on my Complaint against Fire Chief Duffey (No. I-12-100) concerning the appointment of Union Vice President Thomas Heaney as Fire Captain (see Case No. MUPL-12-2352). The issue before the Commission was Mr. Heaneys residency.

On March 7, 2012, Savage filed a request for investigation with the Civil Service Commission (Commission) pursuant to Massachusetts General Laws Chapter 31, Section 2(a) to appeal Heaneys appointment to captain. On May 31, 2012, the Commission dismissed the appeal, allowing the possibility of re-opening the appeal in July 2012 after the Department was able to conduct an internal investigation of the matter.

The Charging Party is presently adjudicating his bypass before the Civil Service Commission in a bypass appeal filed pursuant to G.L. c. 31, 2(b), see Thomas Moughan v. Town of Leicester, Case No. G2-022-71.
