The Highway Division is compromised of assets from the former Massachusetts Highway Department, the former Massachusetts Turnpike Authority, the Department of Conservation and Recreation, and the Massachusetts Port Authority. As such, former MassHighway employees became MassDOT Highway Division employees via operation of law on November 1, 2009. For the purposes of this Decision, the Appellants Employer is the Highway Division of MassDOT. 2 4.

As set forth in the Acts and Resolves of 2009, the Massachusetts Highway Department merged with the Registry of Motor Vehicles, the Massachusetts Bay Transportation Authority, the Massachusetts Aeronautics Commission, the Massachusetts Port Authority and the Massachusetts Turnpike Authority (MTA) to form MassDOT. The former Massachusetts Highway Department and Massachusetts Turnpike Authority now comprise the Highway Division of the MassDOT.
