A settlement was reached in the matter resolving the litigation, which was dismissed in June 2019. As part of the settlement, the Plaintiff agreed to pull the project back from the wetlands and install permanent markers designating a 50-foot no-disturb limit. This matter is now closed.
We also had two prior year wage settlements with large retroactive payments that swallowed up whatever turnover savings would have been generated. Conclusion: we do not expect to replenish free cash. Even though we are falling below the recommended level of free cash, we are placing it into reserves; it is not being spent. After a review of the Supreme Court precedent favoring arbitration of substantive and procedural disputes between the parties, the Court ruled that the issue of the effect of the unions earlier withdrawal of a grievance should be decided by the arbitrator, not the court: Here, the contract stipulates that the arbitration process shall be the sole means of peaceful settlement of all disputes.
Thereafter, the parties engaged in fruitful discussions about settling the grievance and exchanged settlement drafts to resolve the issue. The Union initially forwarded a draft, to which the Employer responded; the Union then incorporated the Citys changes and returned the Agreement for signature. (Exhibits 1, 2 and 3 to the Unions Response).
