The Board made it clear in Town of Brookline, 20 MLC 1570 (1994), even if a particular matter was not covered by the Parties CBA, an employer may not insist on mid-term bargaining during the time that the parties historically [engage] in bargaining for a successor contract. 20 MLC at l596, n.20. The Union specifically put the DOC on notice of this case in their February 17, 2023 letter attached hereto.
