In or about September 2008, a New Bedford Firefighter (whose duties required him to operate a vehicle and possess a valid drivers license) was charged with operating while intoxicated while off-duty, and had his license suspended for three months. He was reassigned to desk duty and ordered to attend EAP counseling. He was eventually given a 24-hour suspension but was not terminated.

The plaintiff was, until his retirement, a firefighter in the city of Springfield; he retired at the rank of fire captain.
