Much like Gardners testimony about a non-existent Association proposal in Employer Exhibit 6, the City presented evidence of settlement discussions regarding the prohibited practice charge at hearing by contending that they did not, in fact, constitute settlement discussions. The Union objected to this information entering the record because the Union argued that it constituted an offer of settlement. I agree with the Union. Regardless, in June 2019, the Union was forced to file the Charge to pursue the information, and the Citys untimely offer in December 2019, is insufficient to satisfy its obligation under the Law.
