At the prehearing investigation conference in this matter, the City cited to both City ofBoston v. Boston Police Patrolmens Assn, 48 Mass. App. Ct. 74 (1999), and Filippone v. Mayor of Newton, 16 Mass. App. Ct. 417 (1983), in support of its position that, as a matter of law, a unilateral change to the preexisting indemnification practice could not constitute a prohibited practice.
City ofBoston v. Boston Police Patrolmens Assn, 48 Mass. App. Ct. 74 (1999), is not on point. In that case, an interest arbitrator who had ruled that the City would be mandated to indemnify officers against judgments was found to have acted beyond the scope of his authority because the award conflicted with General Laws chapter 258, section 9.
Massachusetts Appeals Court articulated and affirmed this statutory discretion in City ofBoston v. Boston Police Patrolmens Assn, Inc., 48 Mass. App. Ct. 74 (1999).
