Matta requested a copy of the settlement agreement regarding the continued employment of a specifically named individual. The City denied his request, claiming that the responsive record is a personnel record exempt from disclosure pursuant to first clause of Exemption (c) of the Public Records Law. G. L. c. 4, 7 (26) (c).
In the September 25 letter, the City claims that the responsive settlement agreement between the City and a specifically named individual is exempt under the first clause of Exemption (c) of the Public Records Law because the record is a personnel record. Specifically, the City explains that the employee "did not receive 'settlement payments' or 'other financial disbursements' as a consequence of the agreement."

Johnsons layoff in the 2010/2011 the parties reached a settlement agreement school year. See Settlement Agreement signed on February 11, 2011 by Boston Teacher Union Vice-President Patrick Connolly attached hereto as Exhibit 2. That agreement provided that Ms. Johnson would be assigned to the Pilot School TechBoston Academy and that the Union would withdraw its grievance in AAA Case No. 11E390-00129-11. Id.
