On January 14, 2013, the Town, as part of its process to hire one permanent full-time firefighter / paramedic, received Certification No. 00361 from the states Human ResourcesDivision (HRD). Mr. Wilson was the top-ranked candidate on the three-person certification. The next two (2) candidates were tied for second.3 All three individuals on the list indicated their willingness to accept the position. (Stipulated Facts and Exhibit 1) 16.
For labor service positions, the Massachusetts Human ResourcesDivision (HRD) has delegated responsibility to the City of Holyoke (Holyoke) Labor Service Director, who is responsible for maintaining lists of the various labor service titles of its municipal employees including employees of Holyoke G&E. (Undisputed Fact; Administrative Notice, 20 MCSR 401) 4.
DeRosa (hereinafter DeRosa or Appellant), is appealing the decision of the Human ResourcesDivision (hereinafter HRD) and the Respondent, Department of Revenue (DOR), denying her request for reclassification from her position as Child Support Coordinator (Job Grade 21) to Special Investigator, DOR I (Job Grade 22) and Special Investigator, DOR II (Job Grade 24) within the DOR. In 2014, the Respondent requisitioned a list of candidates from the states Human ResourcesDivision (HRD) to hire fifty (50) firefighters. (Testimony of Moran; Administrative Notice) 11. Firefighter candidates attend an orientation session and are tested for illegal drug use. Those who pass the drug test are given a detailed application to complete. (Testimony of Moran; Respondents Exh. 2; Administrative Notice) 12.
In January 2017, Holyoke appointed ten (10) candidates to the position of permanent, full-time HFD Firefighter from Certification No. 04132, issued by the Massachusetts Human ResourcesDivision (HRD) from the eligible list of candidates who took and passed the civil service examination for Firefighter administered by HRD on April 16, 2016. (Bacon; Administrative Notice [HRD Form 14 dated 3/13/17 & 3/20/17]) 2.
The process began when the Commonwealths Human ResourcesDivision (HRD) issued an examination for promotion, and then established a list of candidates ranked by their examination scores. The Employer then verified within its own records whether candidates met the requisite license or experience requirements for the position and made a promotional selection off the list in order of ranking. 7.
