On November 19, 2020, the Appellant took and passed the entry-level firefighters civil service examination (originally scheduled for March 21, 2020 but delayed due to the COVID-19 State of Emergency) that was administered by the Massachusetts Human Resources Division (HRD). His name appeared on the firefighters eligible list established by HRD on February 1, 2021, as a Brockton resident.

On December 16, 2016, the Respondent received Certification 04204 from the state Human Resources Division (HRD). The Appellants name appeared second on this Certification. (Jt.Ex. 2) 5. Among the candidates who were ultimately appointed, thirteen (13) ranked below the Appellant on the Certification. (Jt.Exs. 3, 3A) 6. As part of the application process, the Appellant completed a Police Applicant Questionnaire Form.

Pierrelouis took and passed the civil service examination for Correction Officer/Head Cook administered by the Massachusetts Human Resources Division on June 15, 2019. (Exh.12) 4. On or about May 18, 2020, HRD issued Certification #06865 to the DOC to fill positions of Correction Officer/Head Cook. Mr. Pierrelouis appeared third on the Certification.

On or about July 1, 2019, the states Human Resources Division (HRD) established a list of eligible candidates for Correction Officer I. (Stipulated Fact; Resp. Ex. 25) 5. On or about January 1, 2020, per the request of the DOC, HRD sent the DOC Certification No. 06870 for appointment to the position of Correction Officer I. (Stipulated Fact; Resp. Ex. 25) 6.

On December 5, 2017, pursuant to a request of the City to appoint 20 permanent full-time police officers, the Massachusetts Human Resources Division (HRD) issued Certification #05088 to the City. Mr. Sawyers name appeared tied for 19th position on the Certification . (Stipulated Facts) 3.
