Bakers recitation of the Civil ServiceCommissions decision (Responding Party x 5) is inaccurate. The decision clearly notes that, Mr. Baker has failed to make any credible case that his selection for layoff was pretextual or driven by personal bias. He was retained in his job for four years longer than all six of his peers whose positions were eliminated in 2010.
In addition to Grievance 4 and Grievance 5, Baker challenged his layoff at the Civil ServiceCommission, since the Vocational Rehabilitation Instructor was a Civil Service position. A prehearing conference was held on March 11, 2014 and a full evidentiary hearing was held on April 22, 2014. In or around March 2014, the Union and Employer attempted to resolve all outstanding claims and grievances involving Baker through a global settlement.
