He also stated that he had reviewed the Civil Service Commission decision. Bernard stated, The factual information and the findings in the decision are very clear, and address all of the concerns that you raised in our conversation earlier this morning, i.e. harassment, retaliation on union official, your seniority being greater than other employees, etc.
Bakers recitation of the Civil Service Commissions decision (Responding Party x 5) is inaccurate. The decision clearly notes that, Mr. Baker has failed to make any credible case that his selection for layoff was pretextual or driven by personal bias. He was retained in his job for four years longer than all six of his peers whose positions were eliminated in 2010.
In addition to Grievance 4 and Grievance 5, Baker challenged his layoff at the Civil Service Commission, since the Vocational Rehabilitation Instructor was a Civil Service position. A prehearing conference was held on March 11, 2014 and a full evidentiary hearing was held on April 22, 2014. In or around March 2014, the Union and Employer attempted to resolve all outstanding claims and grievances involving Baker through a global settlement.
