On August 5, 2011, the City received Certified Civil Service List No. 202033 from HRD, containing the names of fourteen candidates. The Appellant ranked second on the list; the two highest candidates were tied.

As part of the proposed settlement agreement presented to the DALA administrative magistrate the day of the scheduled hearing, the parties asked the Commission to exercise its powers inherent in Chapter 310 of the Acts of 1993 (310 Relief) and direct the states Human ResourceDivision (HRD) to place the Appellants name at the top of the next certified list for appointment to the position of reserve police officer in the Salem Police Department.
Henderson DECISION Pursuant to the provisions of G.L. c. 31, 2(b), the Appellant, Richard Krasinskas, (hereinafter, Krasinskas or Appellant) seeks review of the States Human ResourcesDivisions (HRD) decision to accept the reasons offered by of the City of Worcester (hereinafter Appointing Authority or City), for bypassing him for original appointment to the position of full-time police officer.
The Town requested an extension of the certification list from the Human ResourcesDivision (hereinafter HRD), but was denied. Because the promotional process was due to expire, the Town Administrator asked Lt. Maass to prepare the letter containing the reasons for the selection of Officer Charlton and the bypass of the Appellant because Acting Chief Harrigan was out of the country on a scheduled vacation at the time.
The Appellant was notified of his bypass for appointment by the Human ResourcesDivision (hereinafter HRD) by letter dated December 8, 2004. The appeal 1 was timely filed. A full hearing was held in the Commissions offices on August 29, 2007. Witnesses offering sworn testimony were not ordered to be sequestered. One audiotape was made of the hearing. The parties submitted proposed decisions thereafter, as instructed.

On September 1, 2021, the states Human ResourcesDivision issued certification 08159 at the request of the City of Somerville. Ms. Lima was tied for 11th position on the certification.
