SUMMARY OF DECISION The City of Brockton had reasonable justification to bypass the Appellant for the position of permanent full time firefighter based on his failure to disclose to a past employer that he had failed a drug screening test administered by a previous employer, his history of excessive use of alcohol, his driving history and poor judgment due to alcohol use.

In 2011, the Commission, pursuant to G.L. c. 31, 2(a), conducted an investigation regarding the review and selection of firefighters in the City of Springfield. (Investigation) 2. While inside the restaurant, the private citizen saw the Appellant drive by the restaurant in his police cruiser at a very low speed on two occasions.
