Then-administrative magistrate Angela C. McConney heard the matter on September 15, 2022.
Pursuant to Commission rules 801 CMR 1.00 et seq, the Commission referred the appeal for hearing to the Division ofAdministrativeLawAppeals (DALA). The DALA Administrative Magistrate issued a recommended decision dated August 14, 2007, which recommended that the Appointing Authoritys oral motion to dismiss the appeal for lack of jurisdiction be allowed.
