The Commission, consistent with the Weinburgh decision, has consistently ruled that there is a two-prong test to determine if a candidate is eligible to sit for a promotional examination for public safety. See ODonoghue v. HRD, 27 MCSR 485 (2014), Nicholas v. HRD, 29 MCSR 358 (2016).
