Prior to making an intermittent appointment, an appointing authority must requisition a certification from states Human ResourcesDivision (HRD) for the number of permanent intermittent vacancies that are to be filled. Upon receipt of such a requisition, HRD issues a Certification to the appointing authority from the eligible list for the entry level position of Firefighter or Police Office, as applicable.
In October 2015, the Human ResourcesDivision (HRD) established the eligible list for police officer. On June 13, 2017, HRD sent certification 04711 to the Appointing Authority. On July 11, 2017, HRD added names at the Appointing Authoritys request. (Stipulated Fact) 18. On June 13, 2017, the Appellants name appeared 13th on Certification No. 04711. (Exhibit 1, Stipulated Fact) 19.
The Commonwealths Human ResourcesDivision (HRD) sent Certification No. 08099 to the Boston Police Department on September 1, 2021. The Appellant was ranked 57th among the eligible candidates. (Stipulated Facts). 3 8. On October 20, 2022, the Respondent bypassed the Appellant for original appointment as a Boston Police Officer.
On September 1, 2021, the states Human ResourcesDivision established an eligible list for Boston Police Officer. On September 23, 2021, HRD issued Certification No. 09099 to the Department, from which it could appoint 115 permanent full-time police officers. Mr. Serebour ranked 41st on the certification. (Exhibit 12) 5.
On September 15, 2021, the Massachusetts Human ResourcesDivision (HRD) issued Certification #08167 and sent it to the City on October 5, 2021. Mr. Hurleys name appeared in a tie group ranked for 6th place on the certification. (Exhibits 5 and 7) 6. The Newton Police Department (Department) assigned Det. Kim Murray to conduct Mr. Hurleys background investigation.
